CTO Renewal: What Most Companies Get Wrong
Consent to Operate renewal should be a routine compliance exercise. In practice, it becomes a crisis every time for a predictable set of reasons: application filed at the last minute (or after expiry), lab reports that are too old, sludge disposal records missing, or water cess payments not up to date.
The SPCB has no obligation to process last-minute renewal applications quickly. Delays are common and leave your plant technically operating in violation during the gap. Some SPCBs issue closure notices to units operating with expired CTO even if the renewal application is pending — a risk that can shut down production.
The professional approach: apply for renewal 3–6 months before expiry, maintain a running compliance folder with current lab reports (refreshed quarterly), water cess payments, and sludge disposal records, and treat CTO renewal as a calendar event rather than a reactive exercise.
Frequently Asked Questions
What is Consent to Operate (CTO)?
CTO is the periodic permission from your State Pollution Control Board authorising you to operate your wastewater treatment and discharge systems under the Water Act 1974. Operating without valid CTO can result in immediate closure.
How long is CTO valid?
Red category: 1–2 years in most states. Orange: 3 years. Green: 5 years. Apply for renewal 3–6 months before expiry to avoid operating with expired CTO.
What documents do I need for CTO renewal?
Core documents: Form II application, site layout plan, recent effluent lab reports (NABL-accredited), water cess payment records, sludge disposal records, ETP maintenance log, previous CTO copy. OCEMS certificate if applicable.
What is the difference between CTE and CTO?
CTE (Consent to Establish) is obtained before construction for new projects. CTO (Consent to Operate) is obtained before starting production and must be renewed periodically. For existing units, CTO renewal is the ongoing obligation.
Can I get CTO if my ETP is under construction?
Yes, most SPCBs grant conditional CTO to units with ETP installation in progress, requiring installation by a specified date. Submit an ETP installation undertaking with your CTO application along with a timeline.
